Terms of Service

1. Acceptance

By using HomeSynk you agree to these terms, which form an agreement between you and 5004812 Ontario Inc. (o/a Dezfoundry Labs) ("we", "us"). If you disagree, do not use the service.

2. Service description

HomeSynk is a collaborative tool for tracking and comparing homes you are considering — on your own, with the people you are house-hunting with, or, on a paid plan, with your clients.

HomeSynk is not a brokerage and provides no brokerage, agency, appraisal, valuation or advisory services. It is not affiliated with CREA, realtor.ca, HouseSigma, or any real estate brokerage. Nothing in HomeSynk is advice about whether to buy, sell or price a property. If you are a licensed real estate professional, your obligations to your clients are yours alone and are unaffected by these terms.

3. Accounts and workspaces

You are responsible for maintaining the security of your account. Sharing your account with others outside your workspace is not permitted.

Minimum age. You must be at least 16 to create a HomeSynk account. To purchase a paid plan you must be at least 18, or the age of majority in your province or territory if that is higher.

4. Plans (Free, Pro, Pro 10, Pro 25)

Subscriptions are per account (not per workspace) and determine your limits:

  • Free: one workspace, up to 2 members, and 10 saved listings.
  • Pro ($4.99/month): one workspace with up to 5 members and 500 listings.
  • Pro 10 ($29.99/month): up to 10 workspaces, each with up to 10 members and 1000 listings.
  • Pro 25 ($79.99/month): up to 25 workspaces, each with up to 15 members and 2500 listings.

Paid plans are billed monthly and auto-renew until cancelled. You can cancel anytime from your profile (tap your avatar). Cancellation takes effect at the end of the current billing period, after which any workspaces that exceed the Free plan are paused (not deleted) until you resubscribe.

5. Refunds

You can cancel anytime (see section 4). Cancelling stops future charges and you keep your paid features until the end of the period you've already paid for.

First charge: if HomeSynk isn't right for you, email support@homesynk.ca within 7 days of your first payment on an account and we'll refund it in full. This applies whether you cancel your subscription or delete your account.

One refund per customer. The first-charge refund is available once. We may decline a request where a subscription has already been refunded, or where we see repeated subscribe-and-refund activity across accounts.

Renewals: monthly renewals aren't automatically refundable, since you can cancel any time before a renewal to avoid it. If something went wrong — you were charged after cancelling, the service was unavailable, or you were billed in error — email us and we'll make it right. Section 11 sets out one further exception, if we make a material change to these terms that you don't accept.

Nothing in this section limits your rights under applicable consumer protection law.

6. Acceptable use

You may not: scrape, bulk-export, redistribute or resell real estate data obtained through HomeSynk; use HomeSynk to build or operate a competing product or service; resell or sublicense access to HomeSynk itself; attempt to circumvent subscription limits; reverse-engineer or abuse the realtor.ca proxy.

Real estate professionals: using HomeSynk on a paid plan to organise house hunts with your own clients is permitted, and is what the Pro 25 plan is built for. The restrictions above still apply — in particular, listing data you access through HomeSynk is for use with your clients inside the product, not to be extracted as a data product or redistributed.

7. Third-party data

Property details are fetched from realtor.ca's unofficial API. HouseSigma listing links are also accepted, but only to extract the address or MLS number from the URL — the underlying details are still looked up via realtor.ca, not fetched from HouseSigma. HomeSynk makes no warranty about accuracy or availability of this data. Always verify directly with the listing agent before making real estate decisions.

8. Disclaimers and limits on liability

HomeSynk is provided "as is" and "as available". To the maximum extent permitted by law, we exclude implied warranties and are not liable for real estate decisions made using this tool, data inaccuracies, service interruptions, or data loss.

What this section does not do. Nothing here limits or excludes your rights under applicable consumer protection legislation, which cannot be waived by agreement; our liability for fraud or fraudulent misrepresentation; or our liability for death or personal injury caused by our negligence.

Where liability can't be excluded, our total liability to you for all claims relating to HomeSynk is limited to the greater of the amount you paid us in the 12 months before the claim arose, or CAD $100.

9. Termination

We may suspend or terminate accounts that violate these terms. You may delete your account at any time from your profile (tap your avatar → Delete my account).

10. Governing law

These terms are governed by the laws of Ontario, Canada, except where mandatory consumer protection law in your province or territory applies regardless of that choice. We'll always try to resolve a problem directly first — email support@homesynk.ca.

If you're a consumer, nothing in these terms limits your right to bring a claim in the courts of your province, including your right to participate in a class action, or your rights under applicable consumer protection legislation.

11. Changes to these terms

What counts as a material change. A change is material if it reduces your rights, increases your obligations, raises the price of a plan you're on, or changes how we use your personal information. Anything else — typo fixes, clarifications, describing a new feature — is not.

Notice. We'll email you at least 30 days before a material change takes effect, saying what is changing and when. Non-material changes take effect when posted.

Your right to cancel. If you don't accept a material change, you can cancel before it takes effect at no penalty, and we'll refund the unused portion of any period you have already paid for — this is an exception to the renewal rule in section 5. If you cancel after the change takes effect, section 5 applies as usual.

12. Accessibility

We want HomeSynk to be usable by as many people as possible. If you hit a barrier — something you can't read, reach, or operate — email support@homesynk.ca and tell us what you were trying to do and what got in the way. We'll reply within 5 business days with what we can do and when. We treat accessibility barriers as bugs, not feature requests.

We can provide the information on this page, and our Privacy Policy, in an accessible format on request. HomeSynk has not been independently audited against the WCAG standard, so we don't claim conformance to a particular level — we'd rather tell you that than imply a guarantee we haven't verified.
